§ 2Scope and Definitions
(1) These General Terms and Conditions apply to all accommodation contracts for the holiday property "Villakasandra", including all associated ancillary services.
(2) The property consists of three units: Apartman Ivan, Apartman Sanja, and Apartman Denis.
(3) Within these Terms, the following definitions apply: an "apartment booking" refers to the rental of a single unit; a "whole-property booking" refers to the rental of all three units. The term "guest" refers to the primary tenant and all accompanying persons.
(4) Differing conditions of the guest apply only if the host has expressly agreed to them in writing.
§ 3Booking and Formation of Contract
(1) Bookings may be made via villakasandra.com (instant booking) or in writing.
(2) For instant bookings, the contract is formed upon submission of the booking details and receipt of the booking confirmation in writing.
(3) For written enquiries, an offer lapses if not accepted within the stated deadline.
(4) Obvious errors or pricing mistakes entitle the host to rescind or correct the booking. Any payments already made will be refunded in full in such cases.
(5) The property is rented exclusively for short-term holiday and leisure purposes. Commercial use, parties, and events are not permitted.
§ 4Right of Withdrawal
No statutory right of withdrawal exists for accommodation services booked for a specific date or period. This does not affect separate distance contracts with an independent service period.
§ 5Prices, Services, and Minimum Stay
(1) The total prices shown at the time of booking apply. These include applicable taxes and — where required by law — tourist or accommodation taxes and all mandatory ancillary charges.
(2) No separate end-of-stay cleaning fee is charged. The property must be returned in an orderly, broom-clean condition on the day of departure.
(3) The minimum stay is two nights. Shorter stays may be agreed on a case-by-case basis.
§ 6Payment Terms
(1) A deposit of 20% of the total price is due upon conclusion of the contract.
(2) The remaining balance is due no later than 30 days before arrival. For later bookings, the full amount is payable immediately.
(3) Available payment methods are bank transfer, PayPal, and credit card. An invoice will be issued upon request in good time.
(4) If payment is not received by the relevant due date, the host is entitled to withdraw from the contract and re-let the property. Statutory default interest applies.
(5) No security deposit is required.
§ 7Arrival, Departure, and Key Handover
(1) Check-in: from 14:00 for apartment bookings, from 16:00 for whole-property bookings. Check-out: by 10:00.
(2) Late check-out is subject to availability only. No legal entitlement exists.
(3) Keys are handed over in person. Guests must communicate their estimated arrival time in advance.
(4) In the event of loss or damage to keys or key fobs, the guest bears the necessary replacement and consequential costs.
§ 8Occupancy, Minimum Age, Visitors, and Pets
(1) The property may only be used by the number of persons stated in the booking confirmation. A maximum of 4 persons per apartment and a total of 12 persons for a whole-property booking applies.
(2) The primary guest must be of legal age.
(3) Day visitors are welcome. Additional overnight guests require prior consent from the host.
(4) Pets cannot be accommodated.
(5) Smoking is prohibited in all indoor areas; outdoors it is permitted only in designated areas. In the event of violations, the costs of any necessary special cleaning may be charged.
§ 9Duty of Care and Condition on Departure
(1) The property and its inventory must be treated with care. Defects and damage must be reported to the host without delay.
(2) On leaving the property, all windows and doors must be closed and all air conditioning units, heating, and lights switched off.
(3) On the day of departure, the property must be left in a broom-clean condition. Rubbish must be disposed of; crockery and kitchen utensils must be cleaned and stored away.
(4) If soiling beyond normal use requires special cleaning, the necessary costs may be charged.
§ 10House Rules
The house rules of the Villakasandra published at the time of booking apply. They form an integral part of the contract and are available at villakasandra.com/hausordnung. In the event of any conflict between these Terms and the house rules, these Terms take precedence.
§ 11Pool and Outdoor Areas
(1) The outdoor areas, including the shared saltwater pool, are available to all guests. Two sun loungers are provided per apartment.
(2) Use is at the guest's own risk, subject to the safety and hygiene rules posted on site.
(3) Children must not use the pool area unsupervised. Supervisory responsibility lies with the parents or guardians.
(4) Glass bottles and glasses are not permitted in the pool area for safety reasons.
(5) Brief maintenance windows of up to 30 minutes may take place during the morning hours.
§ 12Air Conditioning and Energy
Air conditioning units must be operated with care for the environment. Running them with open windows or doors is not permitted. Units must be switched off when leaving the property, unless otherwise agreed.
§ 13Internet Access and Wi-Fi
(1) The host provides complimentary Wi-Fi access. No warranty is given for availability, speed, or uninterrupted service.
(2) The guest undertakes to use the internet connection lawfully. File sharing and access to unlawful content are in particular prohibited.
(3) If there are concrete indications of misuse, access may be temporarily suspended following prior notice. The host's right to claim damages in the event of proven loss remains unaffected.
§ 14Guest Registration (eVisitor) and Identity Documents
(1) All guests must be registered in the national Croatian registration system eVisitor in accordance with applicable law.
(2) The guest must present valid identity documents on arrival and provide the required data for all accompanying persons.
(3) Check-in cannot take place without presentation of the required identity documents.
§ 15Cancellation by the Guest
(1) The following cancellation deadlines apply: Cancellations up to 60 days before check-in (14:00 local time) are free of charge. Cancellations between 59 and 31 days before arrival incur a charge of 50% of the total price. From 30 days before arrival and in the event of no-show, 100% of the total price is charged.
(2) The decisive factor for calculating deadlines is the time at which the cancellation is received by the host in writing.
(3) In the event of a free-of-charge cancellation, any payments already made will be refunded within 14 days via the original payment method.
(4) A no-show is defined as failure to arrive by 24:00 on the arrival date without prior notice.
(5) Transfer of the contract to replacement guests is not provided for.
§ 16Withdrawal and Termination by the Host; Force Majeure
(1) The host may terminate the contract for good cause with immediate effect. Good cause includes in particular serious breaches of contract, serious violations of the house rules, unauthorised parties or events, and endangerment. In such cases, immediate vacation of the property may be required. No right to a refund arises.
(2) In the event of force majeure or official measures (e.g. natural events, widespread utility failures, accommodation bans) that substantially impair or make it impossible to provide the property, payments already made for services not rendered will be refunded. Further claims, in particular reimbursement of travel and consequential costs, are excluded.
§ 17Liability
(1) Statutory liability applies. Limitation of liability does not apply in cases of intent or gross negligence, or in the event of injury to life, body, or health.
(2) Otherwise, liability is excluded. In the event of a slightly negligent breach of material contractual obligations, liability is limited to the typical, foreseeable damage.
(3) No safekeeping is assumed for valuables brought by guests such as cash, jewellery, or electronics.
(4) Service failures beyond the host's control — such as disruptions to public utilities or force majeure — do not give rise to liability.
(5) Car parking areas are not staffed. The driveway and parking area are under video surveillance for security purposes. No liability is accepted for damage to or within vehicles. Details on data processing can be found in the Privacy Policy.
§ 18Guest Liability
The guest is liable for all damage to the property, inventory, and outdoor areas caused by themselves or their accompanying persons. Damage must be reported immediately. The host may demand reimbursement of the necessary repair and restoration costs.
§ 19Privacy
The Privacy Policy published on the website in its current version applies. It contains information on the processing of booking and communication data, hosting and the booking system, payment service providers, cookies and analytics tools, Google Maps, server logs, data subject rights, and video surveillance.
§ 20Applicable Law, Dispute Resolution, and Final Provisions
(1) The law of the Republic of Croatia applies. Mandatory consumer protection provisions of the country in which the guest is habitually resident remain unaffected.
(2) The EU Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr. The host is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
(3) Amendments and supplements to these Terms require written form, unless a stricter statutory form is prescribed.
(4) Should individual provisions be or become invalid, the validity of the remaining provisions is not affected. The invalid provision shall be replaced by the applicable statutory rule.
(5) These Terms are drafted in German. Translations serve solely for ease of use; the German version is always authoritative.
